Hereinafter referred to as the Service Provider, Seller or Oilholder.
2. Scope and acceptance
These Terms of Service apply to purchases made through the Oilholder online store and to contracts arising from such purchases.
By placing an order, the customer accepts the Terms of Service in force at the time the order is placed.
Matters not expressly governed by these Terms are subject to applicable Hungarian law and, where applicable, European Union law.
3. Products
Product pages in the Oilholder online store provide the essential characteristics, available variants, dimensions and prices of the products.
The products are made from natural wood. As wood is a natural material, its colour, grain, pattern, shade and other natural characteristics may vary from one product to another. Such natural variations do not in themselves constitute a defect, provided that the product otherwise conforms to the contract.
Product photographs are intended to represent the products as accurately as possible. Due to differences in screen settings and the natural characteristics of wood, actual colours and shades may vary slightly from those displayed on screen.
4. Prices
Prices displayed to customers in the online store are shown in accordance with the settings applicable to the relevant market.
Before completing an order, the customer is shown the price of the products, the applicable shipping charge and the total amount payable.
For deliveries to countries outside the European Union, customs duties, import taxes, local taxes, customs-clearance fees or other governmental charges may apply under the rules of the destination country. Unless expressly indicated otherwise during checkout, these charges are not included in the purchase price or shipping charge collected by Oilholder and may be payable by the customer.
In the event of an obvious pricing error, for example where a technical error results in a clearly unrealistic price, the Seller is not required to fulfil the order at the erroneous price. The customer will be informed without undue delay and may confirm the order at the correct price or cancel it.
5. Orders and formation of the contract
The customer places the selected products in the shopping cart, provides the information required to fulfil the order, selects an available shipping and payment method, reviews the order summary and submits the order.
Before submitting the order, the customer can review and correct the information entered, the contents and quantities in the cart and the available shipping and payment options.
Receipt of the order is confirmed electronically.
The automatic confirmation confirms that the order has been received by the Oilholder system. Where the confirmation also clearly constitutes acceptance of the customer's order, the contract is formed upon that confirmation. Otherwise, the contract is formed when Oilholder subsequently confirms acceptance of the order.
If the electronic confirmation is not received by the customer within 48 hours after submitting the order, the customer is no longer bound by the offer.
6. Refusal or cancellation of orders
Oilholder may refuse or cancel an order where there is a justified reason, including where a product is unavailable; an obvious pricing or technical error has occurred; payment has failed or cannot be verified; there are reasonable grounds to suspect fraud or abuse; delivery cannot be made to the address provided; or fulfilment would breach applicable law or an official restriction.
If Oilholder is unable to fulfil an order that has already been paid for, the amount paid will be refunded.
7. Payment
The payment methods currently available are displayed during checkout.
Card payments and certain electronic payments may be processed through Shopify and, depending on the selected method, Shopify Payments, participating banks, card networks or digital-wallet providers.
Oilholder does not store complete payment-card details.
8. Invoicing
The Seller issues invoices in accordance with applicable law.
Oilholder uses the Billingo electronic invoicing system.
Customers are responsible for providing accurate billing information.
9. Processing time
Orders are generally processed within 1â2 business days.
Processing time is separate from delivery time. Estimated delivery times are calculated from dispatch.
10. Shipping
Oilholder ships to Hungary and to international destinations shown as available in the online store.
Available domestic delivery methods may include MPL and FOXPOST. International shipments may, among other options, be delivered by DHL.
The shipping methods, charges and options currently available for a particular order are displayed at checkout.
Further details are set out in our Shipping Policy.
11. Transfer of risk
In consumer contracts, the risk of loss of or damage to the goods passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.
Where the consumer independently commissions a carrier that was not offered by the Seller, risk passes when the goods are handed over to that carrier.
12. International orders, customs and import charges
Orders shipped outside the European Union may be subject to the customs and tax rules of the destination country.
Customs duties, import taxes, customs-clearance fees and other governmental charges imposed in the destination country may be payable by the customer where they have not been collected during checkout.
Oilholder cannot guarantee in advance the amount of charges imposed by the authorities of a particular country.
Oilholder is not responsible for delays caused by customs clearance or governmental inspection where those delays arise from circumstances outside its control.
13. Consumer right of withdrawal
Consumers entering into distance contracts generally have a 14-day right to withdraw without giving a reason, calculated from receipt of the goods, subject to applicable statutory exceptions.
Oilholder provides an electronic withdrawal and return facility. The âWithdraw from or return an orderâ function available in the footer of the online store allows customers to initiate a withdrawal or return through their customer account.
Use of the online function is not the exclusive means of exercising the statutory right of withdrawal. Consumers may also send an unequivocal withdrawal statement to hello@oilholder.com or use the statutory model withdrawal form.
Detailed provisions concerning withdrawal, returning goods, return costs, refunds, diminished value and exceptions to the right of withdrawal are set out in our Return & Refund Policy.
14. Custom-made and personalised products
Where provided by applicable law, the right to withdraw does not apply to goods that are not prefabricated and are made on the basis of an individual choice or decision by the consumer, or to goods that are clearly personalised.
Examples may include customer-specific dimensions, hole arrangements, engraving or other modifications expressly requested by the customer.
The fact that a product is handmade or made to order does not by itself exclude the right of withdrawal.
Where the statutory right of withdrawal does not apply to a particular product, the customer will be informed before the contract is concluded.
15. Conformity and defective goods
The Seller is required to supply goods that conform to the contract.
Where goods do not conform to the contract, consumers are entitled to the statutory remedies and consumer rights provided by applicable law.
Where the applicable statutory requirements are met, remedies may include repair or replacement and, in circumstances provided by law, a price reduction or termination of the contract.
Nothing in these Terms or any other Oilholder policy limits a consumer's mandatory statutory rights.
For defective, damaged or non-conforming goods, please contact hello@oilholder.com.
16. Complaints
Complaints concerning products, orders or Oilholder's activities may be submitted using the following contact details:

17. Alternative dispute resolution
In the event of a consumer dispute, consumers may apply to a competent Hungarian conciliation body for out-of-court dispute resolution.
The body competent according to the Seller's registered office is:
FejĂ©r County Conciliation Board (FejĂ©r VĂĄrmegyei BĂ©kĂ©ltetĆ TestĂŒlet)
Address: 8000 SzĂ©kesfehĂ©rvĂĄr, HosszĂșsĂ©tatĂ©r 4â6., Hungary

Its territorial jurisdiction covers Fejér, Komårom-Esztergom and Veszprém counties.
Consumers may initiate proceedings before the competent conciliation body in accordance with applicable law. Oilholder complies with its statutory duty to cooperate in conciliation proceedings.
18. Privacy
Detailed information concerning the processing of personal data is provided in Oilholder's Privacy Policy.
Personal data is processed only on an appropriate legal basis and in accordance with applicable data-protection law.
19. Intellectual property
Texts, photographs, graphics, logos, product presentations and other content appearing on the website may be protected by copyright, trademark or other intellectual-property rights.
Except where permitted by law, unauthorised commercial use, copying, modification or distribution of such content is prohibited.
20. Shopify's role
Shopify provides the technical infrastructure for the Oilholder online store.
The seller of the products and the contracting party in the sales contract with the customer is Mazsola MƱhely Szolgåltató Szociålis Szövetkezet, not Shopify.
Shopify is not the seller of the products offered through the Oilholder online store.
21. Liability
Oilholder is responsible for the performance of its contractual obligations in accordance with applicable law.
Nothing in these Terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.
Subject to mandatory statutory provisions, Oilholder is not liable for delay or failure to perform caused by circumstances beyond its control that could not reasonably have been foreseen at the time the contract was concluded and could not reasonably have been avoided or overcome.
22. Contract language, records and accessibility
The online store is available in English, Hungarian and German.
The language of the contract may be the available language used by the customer during the purchasing process.
Order information is processed and retained by Oilholder and the e-commerce system in accordance with applicable legal and data-protection requirements. Customers receive electronic confirmation of their orders.
The contract is not regarded as a contract concluded in writing under Hungarian law and is not separately filed by Oilholder as a document subsequently accessible directly to the customer, without prejudice to the statutory retention of order and invoicing records.
23. Governing law and disputes
These Terms and contracts concluded with Oilholder are governed by Hungarian law, subject to applicable rules of private international law.
This choice of law does not deprive a consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence where those provisions are applicable and cannot be derogated from by agreement.
The parties will seek to resolve disputes amicably where possible. Nothing in these Terms limits a consumer's right to apply to a competent authority, conciliation body or court.
24. Changes to these Terms
Oilholder may amend these Terms for the future, particularly as a result of changes in law or changes to the operation, services or technical systems of the online store.
Changes do not retrospectively affect rights and obligations arising from contracts already concluded.
The version of the Terms in force when an order is placed applies to that purchase.
